  • Garner all network construction and continued use approvals required of the above entities and building owners for the installation and continued of their infrastructures and coordinate with and project manage them during construction and post-construction.
  • Building, site and ROW protection services of clients’ established rights for the operation and continued uninterrupted use of their telecommunication networks.
  • Manage, collaborate and coordinate with all stakeholders of Legal, Engineering, Finance, Tax, Government Affairs and Risk Management during the processes of site, ROW and building access rights acquisitions.
  • Negotiate rail crossing and railroad longitudinal right of way and license agreements for the installation of client networks.
  • Manage structure access requests allowed under the Telecom Act if client is a Competitive Local Exchange Carrier (CLEC) and needs to lease available space upon poles or within underground conduit of an Incumbent Local Exchange Carrier (ILEC), Power Company or similar agency.
  • Experienced with and knowledgeable in telecommunications building access (including riser and roof top access and use), ROW, private easements, licenses and building leases and land purchase contracts for telecommunications equipment and cabling placements.
  • Experienced with and knowledge in the entire site and land acquisition process, including: ability to direct and understand site surveys, ability to read and interpret engineered drawings, ability to review, understand and clear issues regarding land title, and knowledge in all the required parts needed in a site/building access/ROW/land acquisition Package prior to document executions.
  • Lead real estate, building access and right of way (ROW) acquisition negotiations for client’s wireless and wireline site acquisition needs.
  • Develop and review all required documents and agreements necessary for the legal acquisition of sites and ROW and rights of building access for telecommunications purposes both wireless and wireline.
  • Project manage the full life cycle process of site and ROW acquisition and building access from identification to seeking and selection to final procurement and post-execution rights maintenance.
  • Make recommendations to clients respecting the suitability of sites, ROW and buildings needed, to include associated business decisions and contractual terms and conditions so that client’s network and business objectives are met. Provide a selection of sites and ROW options that clients can choose from.
  • Engage building owners, utilities, municipalities and other governmental entities to ensure all access, site and ROW policy, procedures, rules and regulations are understood and met and conveyed these to clients to ensure conformance.
  • Draft, review and revise complex real estate, ROW and building access contract provisions for acquisitions and access.
  • Ensure that sites and ROW contain no title or lien holder or claim encumbrances that could preclude the “quite enjoyment”, legal and uninterrupted occupancy and use of the site and ROW by clients.
  • Experienced with and knowledge in the entire site and land acquisition process, including: ability to direct and understand site surveys, ability to read and interpret engineered drawings, ability to review, understand and clear issues regarding land title, and knowledge in all the required parts needed in a site/building access/ROW/land acquisition Package prior to document executions.
  • Ability to understand complex business and network development plans and specifications and to successfully negotiate contract terms and conditions to meet client objectives. Make recommendations to clients, including developing solutions to complex wireline and wireless implementation challenges.
  • Subject to any NDA restrictions and on behalf of clients, compare competitor agreements, note variations, and negotiate for equitable treatment in all agreements.
  • Knowledgeable in Federal, State and local Telecommunication Regulations governing use of public right of way and other regulations regarding a telecommunications provider’s use of municipal rights of way.
  • Familiarity with building owner network access construction requirements and utility construction permit application processes at the municipal (city/county) level, including telecom outside plant construction terminology and techniques, facility locates, pole attachments and engineering plans.
  • Ensure that sites and ROW contain no title or lien holder or claim encumbrances that could preclude the “quite enjoyment”, legal and uninterrupted occupancy and use of the site and ROW by clients.
